Roberts’ Bumpy Road to
the High Court

WASHINGTON - Just minutes into John Roberts' Supreme Court nomination
hearing today came questions about his views on abortion.
There was a different tone today as Roberts’ hearing moved
into its second day. Monday was a day for speeches and smiles.
Tuesday was probing and serious.
And literally, a minute or two into the hearing, Chairman Senator
Arlen Specter (Pa.), a pro-choice Republican, started to quiz
Roberts on abortion.
Roberts may vote to overturn Roe v. Wade. Specter, and many liberal
Democrats believe Roberts should respect past Supreme Court decisions.
It is called ‘stare decisis.’
Roberts says generally, he does believe in this, but he did leave
an opening. Roberts mentioned the idea of subsequent developments.
Pro-life groups were happy to hear that, because for years they
have been saying there have been medical advances regarding ultrasound
equipment, and how babies can be saved at earlier stages. All
of this since Roe was decided 30 years ago.
Another topic today was civil rights. Democrats, including Senator
Ted Kennedy, have some real concerns that Judge Roberts will scale
back affirmative action programs. Also, he implied that previous
memos written by Roberts made it seem that he was insensitive
to the Voting Rights Act, which tried to help minorities overcome
racial prejudice.
No one said it would be easy being chief justice. Roberts is
finding out that the path may not be a smooth one.
